Terms of Service

Deux is a technology platform that connects independent users. We provide the tools and infrastructure for "Clients" (who need services or goods) and "Professionals" (who provide services or sell goods) to find each other and transact.

All users — whether acting as Professionals or Clients — use Deux as independent parties. No employment, partnership, joint venture, agency, or franchise relationship is created between you and Deux by these Terms or your use of the platform.

• Professionals set their own hours, methods, tools, and prices. They bear full responsibility for the legality, quality, and delivery of their services or goods.
• Clients are solely responsible for evaluating, selecting, supervising, and paying the Professional they hire. Deux does not vet or certify Professionals beyond the behavioral trust score described in Section 5.

To create an account and use Deux, you must meet ALL of the following conditions at all times:

• You are at least 18 years old. We do not knowingly allow users under 18. If we discover a user is under 18, we will terminate the account immediately.
• You have the legal right to work in, provide services in, or receive services in the country where you operate.
• You have not previously been suspended, banned, or removed from Deux or any affiliated service.
• You represent only yourself — not a corporation or multiple individuals — unless you have entered into a separate written agreement with Deux for business accounts.
• All registration information you provide is accurate, current, and complete. You agree to keep it updated.

Deux is currently available in select countries where our payment processors operate. We do not guarantee service availability in all regions and may restrict or terminate access in any jurisdiction at our sole discretion, including for regulatory or compliance reasons.

Platform Fee

Deux charges a withdrawal fee on earnings withdrawn by Professionals. The current fee rates are displayed in your account Balance & Payouts section and may vary by plan:

• Free plan: standard withdrawal fee rate (see app for current rate)
• Deux Elite: reduced withdrawal fee rate
• Deux Elite+: lowest withdrawal fee rate

Deux reserves the right to modify fee rates at any time with 30 days' notice to active users. Continued use of the platform after such notice constitutes acceptance of the new rates.

Escrow and Payment Protection

Where the escrow feature is available, funds paid by Clients for a job are held in escrow until the job is marked complete and confirmed. Deux is not a bank or payment institution. Escrow funds are processed by our third-party payment partner (FedaPay) and are subject to their terms and conditions.

Funds are released to the Professional when the Client confirms job completion, or automatically after the applicable review window expires.

Refund eligibility depends on the stage of the job at time of cancellation, as described in our cancellation policy. Deux does not guarantee refunds in all circumstances and retains sole discretion to determine refund outcomes in disputed cases.

All transactions are processed in the local currency supported by our payment processor for your region. Deux is not responsible for currency fluctuation, exchange rate losses, or failed transfers caused by your mobile money provider.

Subscription Plans (Elite and Elite+)

Deux Elite and Deux Elite+ are recurring subscription plans billed monthly or annually. By subscribing, you authorize Deux to charge your payment method on a recurring basis at the then-current subscription price.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused portions of a subscription period.

Subscription plans provide platform benefits (reduced fees, boosted discovery, Trust Score acceleration). They do not guarantee jobs, earnings, client contacts, or any specific business outcome.

Deux may change subscription prices with 30 days' advance notice. If you do not cancel before the price change takes effect, you consent to the new price.

Content Creator Program and referral incentives

Deux may operate a Content Creator Program through which eligible users share referral links and may earn incentives when referred users qualify under rules shown in the product.

Standard Content Creator Program: where enabled, content creators earn twenty percent (20%) of Elite and Elite+ subscription amounts actually charged to referred users who joined through their content creator link, for thirty-six (36) months starting from each referred user’s first successful subscription payment, only while that subscription remains active. Commission is calculated on net amounts charged each billing cycle, including after introductory discounts displayed at checkout. Content creator eligibility also requires at least one successful signup through the content creator’s link every six (6) months; inactive content creators forfeit future commissions on previously referred users.

Content creators separately invited by Deux as Launch Content Creators for a country debut may earn the same twenty percent (20%) rate for sixty (60) months per qualifying referred subscriber under supplementary partnership terms communicated privately to those invitees only (they are not published as part of the standard Content Creator Programme materials shown to every user).

People joining through a valid content creator link may receive promotional pricing or reduced withdrawal fees when shown at signup or checkout for their region (for example discounted first subscription months or reduced fees on early professional activity). Offers vary by region and may change.

Referral attribution must follow eligibility rules shown in the product (such as new-account requirements, first-touch attribution to one referrer, and prohibition of self-referral where stated). Deux may withhold or adjust incentives where attribution is unclear, abusive, or fraudulent.

Deux may modify Content Creator Program mechanics with reasonable notice consistent with Section 15 (Changes to These Terms).

Deux's goods marketplace allows Professionals operating in 'goods' mode to list and sell physical products. The following additional terms apply:

• Sellers are solely responsible for the accuracy of product listings, the condition and legality of goods offered, all applicable taxes on sales, and fulfillment and delivery of orders to buyers.
• Deux does not operate a logistics or shipping service. Delivery arrangements are made solely between the buyer and seller. Deux is not liable for lost, damaged, delayed, or undelivered goods.
• Delivery confirmation is completed via the buyer's Deux Code. By entering the buyer's Deux Code, the seller confirms delivery and authorizes escrow release. Sellers should not enter a Deux Code until physical goods have been handed over.

Deux uses a proprietary Trust Score system (0–100) to help users evaluate the reliability of Professionals on the platform. By using Deux, you explicitly consent to the following:

The 'Verified' or 'Top Rated' badge shown on a profile indicates strong past on-platform performance. It does NOT constitute identity verification, a background check, a criminal record check, or any form of endorsement by Deux of the user's character or fitness for any purpose.

Deux collects, processes, and retains your behavioral data as described in our Privacy Policy. In the future, and only with your explicit consent, your behavioral profile data may be made available to trusted third-party partners to support services that may benefit you. You will always be given a clear opt-in choice before any such sharing occurs. Deux will never sell personally identifiable information to third parties without your separate, explicit consent.

Phone number verification and ownership

A phone number may only be actively linked to one Deux account after successful SMS verification. Escrow payments and withdrawals are available with push sign-in; paid Elite subscriptions require SMS verification.

When you verify a phone number by SMS, you become the verified owner of that number on Deux. Any other account that claimed the same number without SMS verification may automatically lose that association.

Deux may automatically suspend accounts that used a phone number without verifying it, when the legitimate owner completes SMS verification. Suspended accounts cannot use wallet, withdrawals, subscriptions, or other protected features until reviewed by support.

To protect users, maintain platform integrity, and prevent transactions from being taken off-platform before payment protection is in place, Deux monitors in-app messages for certain types of content.

Our systems may automatically scan messages for contact information (phone numbers, email addresses, social media handles, external URLs) when a job or order is in a pre-escrow stage. Messages that contain such information may be flagged, delayed, or blocked, and you will be notified.

You should not have an expectation of privacy in messages sent through the Deux platform regarding contact information sharing or off-platform solicitation. We may use flagged message data for enforcement purposes.

The trust of our community depends on honest behavior. The following conduct is prohibited and will result in account penalties or termination:

• Creating fake accounts, duplicate accounts, or using another person's identity to post reviews or boost ratings.
• Arranging for friends, family, or third parties to post fake or misleading reviews.
• Offering payment, gifts, or any other incentive in exchange for positive reviews.
• Using any technical or social method to artificially inflate your Trust Score, job count, or rating.
• Soliciting or accepting payment outside the platform for jobs or goods listed on Deux.
• Harassing, threatening, or discriminating against any user on the basis of race, gender, religion, national origin, disability, or any other protected characteristic.
• Misrepresenting your identity, qualifications, or the nature of services or goods offered.
• Submitting false reports, disputes, or complaints against other users in bad faith.

Reviews Are User Opinions

All reviews, ratings, and comments on Deux are the opinions of individual users and do not represent the views, opinions, or statements of Deux. Deux does not verify, endorse, or guarantee the accuracy of any review content.

Your Responsibility for Review Content

When you post a review, you represent and warrant that:

• The review is based on your actual experience with a completed job or order
• The review contains your honest opinion, not false statements of fact
• The review does not contain defamatory, libelous, or malicious content
• You will not post reviews that violate any laws or infringe on others' rights

Prohibited Review Content

You agree NOT to post reviews that:

• Contain false statements of fact (as opposed to opinions)
• Are defamatory, libelous, or malicious
• Violate privacy rights or disclose confidential information
• Are posted by someone who did not actually complete a job or order
• Are intended to harm someone's reputation maliciously

Our Right to Moderate

Deux reserves the right, but not the obligation, to:

• Review, edit, or remove any content at our sole discretion
• Remove content that violates these Terms or our Community Guidelines
• Remove content that is flagged by users or reported as inappropriate
• Take action against users who post prohibited content

No Liability for User Content

Deux is not responsible or liable for:

• The content, accuracy, or truthfulness of any review or user-generated material
• Any harm or damage caused by user-generated content
• Any disputes arising from reviews or content between users
• Any legal claims related to user-generated content

Indemnification for Your Content

You agree to indemnify, defend, and hold harmless Deux, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Any content you post, submit, or transmit on the platform
• Your violation of any provision of these Terms
• Any claim that your content or conduct infringes on another party's rights

How to Share Your Experience Safely

To help you share your experience while protecting yourself and others, here are guidelines for writing reviews:

• Facts about what happened: "After the job ended, I discovered [specific items] were missing" or "The work was not completed as agreed"
• Your honest opinions: "I would not recommend this professional" or "I felt uncomfortable with their behavior"
• Descriptions of your experience: "I had concerns about their reliability" or "The service did not meet my expectations"

Deux's Intellectual Property

The Deux platform, including its name, logo, design, software, algorithms (including the Trust Score algorithm), data structures, and all related technology, is owned by Deux and protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of or any license to Deux's intellectual property beyond what is strictly necessary to use the platform.

License You Grant to Deux

By posting content on Deux — including profile information, photos, portfolio items, job listings, reviews, ratings, or any other material — you grant Deux a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, display, reproduce, modify, adapt, publish, and distribute that content for the purposes of operating, improving, and promoting the platform.

You retain ownership of your content. This license ends when you delete your content or close your account, except where your content has been shared by others (e.g., in a review), where Deux may retain a copy for record-keeping, dispute resolution, or legal compliance purposes.

THE DEUX PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEUX EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the platform will be uninterrupted, error-free, secure, or free of viruses or harmful components.
• Any warranty as to the accuracy, completeness, or reliability of any content, listings, reviews, or Trust Scores on the platform.
• Any warranty that use of the platform will result in any particular business outcome, earnings, hires, or other results.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEUX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: loss of profits, loss of data, loss of goodwill, personal injury, property damage, or any other loss arising from or relating to your use of the platform.

Some jurisdictions do not allow the exclusion or limitation of liability for certain damages. In such jurisdictions, Deux's liability is limited to the greatest extent permitted by law.

Deux reserves the right to suspend or permanently terminate your account at our sole discretion, with or without prior notice, for: violation of these Terms or any policy, conduct that Deux deems harmful to the community, inactivity for extended periods, legal or regulatory requirements, or any other reason Deux determines appropriate.

Upon termination: your access to the platform ceases immediately, any pending job or order must be resolved according to the escrow and dispute policies then in effect, earned and confirmed balances will be paid out in accordance with our standard payout process, and any unearned or disputed funds may be withheld pending resolution.

You may close your account at any time through account settings. Closing your account does not release you from any obligations arising from transactions in progress, and does not entitle you to a refund of any subscription fees paid.

These Terms are entered into with Deux Technologies SARL, a company registered in the Republic of Benin. They are governed by and construed in accordance with the laws of the Republic of Benin and, where applicable, the OHADA Uniform Acts. For users located in countries with mandatory consumer protection laws that cannot be waived by contract, those local protections continue to apply.

Before initiating any formal dispute process, you agree to contact Deux at contact@getdeux.com and attempt to resolve the dispute informally for at least 30 days.

If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or your use of the platform shall be resolved through binding individual arbitration administered under applicable arbitration rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent harm pending arbitration.

These Terms are written in English. Any translation provided is for convenience only. In the event of conflict between the English version and any translation, the English version prevails.

Deux may update these Terms at any time. When we make material changes, we will notify you by: posting the updated Terms with a new effective date, sending a notification through the app or to your registered phone number, or both.

Your continued use of the platform after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to updated Terms, you must stop using the platform and may close your account.
